Terms and Conditions
Last updated: September 5, 2026
1. Introduction and Acceptance
Welcome to Create a QR. These Terms and Conditions govern your use of our website and services. By creating an account (including checking the agreement box at sign-up or continuing through a third-party sign-in), or by accessing or using our platform, you agree to be bound by these terms, including the binding arbitration provision and class action waiver in Section 12. If you do not agree, do not use the service.
2. Eligibility
You must be at least 13 years old to use the service, and at least 18 (or the age of majority where you live) to purchase a subscription. If you use the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. User Obligations and Acceptable Use
- Provide accurate and complete information when prompted.
- Comply with all applicable laws and regulations.
- Refrain from using our service for any unlawful purpose.
You may not use the service — including QR codes and short links — to:
- link to or distribute phishing pages, malware, spyware, or any content designed to deceive, defraud, or harm;
- disguise a link's destination in a misleading way, or redirect to content that differs materially from what was represented when the code was shared;
- distribute spam, illegal content, or content that infringes intellectual property or privacy rights;
- probe, overload, or disrupt the service, or attempt to enumerate or access links and data belonging to others.
We may disable any link or QR code, suspend or terminate any account, and remove any content at our sole discretion, with or without notice, if we reasonably believe these Terms have been violated or the service is being abused. Abuse can be reported to contact@createaqr.com.
4. Third-Party Content and Link Destinations
QR codes and short links created with the service redirect to destinations chosen by the person who created them. We do not create, control, endorse, or assume responsibility for any destination content. Scanning a QR code or following a short link is at your own risk, and any dealings with third parties reached through the service are solely between you and that third party.
5. Intellectual Property
All content, features, and functionality of the service are the exclusive property of Create a QR and are protected by applicable intellectual property laws. You retain ownership of the content you supply (such as link destinations, logos, and designs) and grant us the license needed to host, display, and process it to operate the service.
6. Subscriptions, Billing, and Cancellation
Paid plans are billed through our payment processor (Stripe) on a recurring monthly or yearly cycle and renew automatically until cancelled. You can cancel at any time from your account's billing portal; cancellation stops future charges and your plan remains active through the end of the paid period. Except where required by law or expressly stated otherwise, fees already paid are refundable only as described in Section 9. We may change plan pricing with notice, effective at your next renewal.
7. Service Changes and Link Lifecycle
We may modify, suspend, or discontinue any part of the service (including the free tier) at any time. Dynamic QR codes and short links depend on the service remaining available: links may stop resolving if your account is terminated, if a link is disabled under Section 3, or if the service is discontinued. Links created without an account expire ninety (90) days after creation unless claimed into an account. Test QR codes before printing, and keep your own copy of important destination URLs.
8. Disclaimer of Warranties
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, that QR codes or short links will remain scannable or reachable indefinitely, or that stored data will not be lost. You are responsible for testing QR codes before printing or distributing them.
9. Limitation of Liability
To the fullest extent permitted by law, Create a QR and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of (or inability to use) the service, even if advised of the possibility of such damages.
To the fullest extent permitted by law, the total aggregate liability of Create a QR for all claims arising out of or relating to the service or these Terms shall not exceed the amounts you actually paid to Create a QR for the service in the twelve (12) months preceding the event giving rise to the claim — that is, your sole and exclusive remedy is limited to a refund of the fees you paid. If you use only the free tier, this amount is zero. These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and survive failure of essential purpose of any limited remedy. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Create a QR and its owners, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the content you supply, the destinations you link to, your use of the service, or your violation of these Terms or of any third party's rights.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. The Federal Arbitration Act governs the interpretation and enforcement of Section 12.
12. Dispute Resolution — Binding Arbitration and Class Action Waiver
Please read this section carefully — it affects your legal rights.
Informal resolution first. Before filing a claim, you agree to contact us at contact@createaqr.com with a written description of the dispute and give us sixty (60) days to resolve it informally.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the service that is not resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted by a single arbitrator, in English, and may be conducted remotely by videoconference or on written submissions. Judgment on the award may be entered in any court of competent jurisdiction.
Class action and jury waiver. You and Create a QR each waive the right to a trial by jury and agree that disputes may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or prevent unauthorized use of the service.
30-day opt-out. You may opt out of this arbitration agreement by emailing contact@createaqr.com with the subject "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms. Opting out does not affect any other provision of these Terms.
Severability. If any part of this section is found unenforceable, the remainder shall remain in effect, except that if the class action waiver is found unenforceable, this entire arbitration section shall be void.
13. Changes to These Terms
We may update these Terms from time to time. For material changes we will provide reasonable notice — by updating the "Last updated" date above and, for account holders, by email or an in-product notice — before the changes take effect. Continued use of the service after changes take effect constitutes acceptance. Questions about these Terms can be sent to contact@createaqr.com.
